On March 9th, 2016, we received another EB-2 NIW (National Interest Waiver) approval for a Research Assistant in the Field of Chemical Engineering (Approval Notice).

General Field: Chemical Engineering

Position at the Time of Case Filing: Research Assistant

Country of Origin: Iran

Service Center: Texas Service Center (TSC)

State of Residence at the Time of Filing: Florida

Approval Notice Date: March 9th, 2016

Processing Time: 3 months, 7 days

Case Summary:

The USCIS spent a little over three months reviewing this EB-2 NIW (National Interest Waiver) petition before granting their approval. Our client, a research assistant from Iran, chose to file the final step of the green card process (the I-485 application) alongside his NIW petition. Known as concurrent filing, this allowed him to slice down the overall wait time for permanent residency. He received his green card approval notice a little over a month after he received his NIW approval.

A large part of our job involved putting together a strong and convincing EB-2 NIW petition for our client. Our goal was to convince the USCIS that his research is of great value to the United States and that not many other chemical engineers with similar qualifications can attain similar research success. Here are some of the steps that we took in preparing the petition:

  1. Detailed his research efforts: Our EB-2 NIW petition packet contained details on our client’s research endeavors on polymer science and engineering. We demonstrated that his work on microcellular foaming of polymers and structure-property relation in semi-crystalline polyolefins impact the global plastics industry and American oil and gas sectors.
  1. Highlighted his publication record: At the time of filing, our client had 8 journal articles, 4 conference papers, and 1 patent to his name.
  1. Documented his citation count: Our client’s work had gathered 70 citations when we filed his NIW case. This provided the USCIS with proof that our client’s input is essential to the progress of other engineers’ research efforts.
  1. Included testimonials: We helped our client select several recommenders who were willing to speak highly of his investigations. The four recommendation letters that our client gathered did just that. One of the letters stated, in part, “It is highly important that [Client] continue his work, as he is producing constant breakthroughs that are enhancing policy and research […] [Client’s] work keeps the U.S. competitive on a global level and sparks a plethora of additional research from his colleagues […] It is absolutely necessary that [Client’s] work be able to continue for the benefit of the chemical engineering field and for the best interests of the United States.”
  1. Wrote a strong petition letter: Going off all the information that we had gathered on our client’ various accomplishments, we put together a carefully worded petition letter summarizing all the facts. From our client’s master’s degree to descriptions of his research, we did not leave anything out.

North America Immigration Law Group (WeGreened.com) would like to take this opportunity to congratulate our client on becoming an American permanent resident, and we thank him for selecting our firm to represent his case.
