Case Summary:
A senior researcher engaged in the field of computational fluid dynamics hired North America Immigration Law Group (WeGreened.com) to file an EB-1B (Outstanding Professors and Researchers) petition for him. As EB-1B is an employer-based petition, our client’s employer—a private company—agreed to serve as the petitioner.
Legal Strategy:
Once the contract was signed and returned to us, our legal team immediately got to work. While we were preparing the EB-1B petition packet, we advised our client to touch base with other influential researchers in his field and request for recommendation letters. Our client managed to gather six strong testimonials, which together, played a very important role in our petition. These letters supported our argument that our client’s work is essential to not just the field but the United States as a whole. For example, one of these letters stated, “Based on his past accomplishments, manifested through his highly cited publications and extensive peer review service, [Client] is undoubtedly considered one of the leaders in the field. His top position indicates the necessity of his presence for future advancements in combustion systems.” Furthermore, we used details from these letters to firmly demonstrate to the USCIS that our client’s investigations on developing and implementing computational models to predict turbulent reacting flows, developing numerical models to predict the fire performance of drywall, and using software to design optimal components for the drywall manufacturing process are important to the nation.
Besides accounts of our client’s research and recommendation letters, our EB-1B petition packet was also comprised of our client’s peer review, citation, and publication record. At the time of filing, these numbers stood at 50 reviews, 66 citations, and 5 publications.
Notice of Intent to Deny (NOID):
Despite our client’s strong credentials, the USCIS issued a Notice of Intent to Deny (NOID). Our legal team addressed the NOID in an effective and efficient manner and two weeks after we responded to the NOID, the USCIS approved our EB-1B petition. We are extremely pleased with this outcome and we thank our client for selecting us to represent his case. We recently filed I-485 applications (last hurdle in the green card journey) for our client and his wife, and we join them as they await the final decision from Nebraska Service Center. In the meantime, North America Immigration Law Group wishes our client well as he continues to advance the field of computational fluid dynamics.
