General Field: Biomedical Science

Position at the Time of Case Filing: Postdoctoral Fellow

Country of Origin: China

Service Center: Texas Service Center (TSC)

State of Residence at the Time of Filing: Texas

Approval Notice Date: February 25th, 2016

Processing Time: 37 days

Case Summary:

After merely 37 days, the USCIS sent us a notice informing us that our client’s I-140 petition had been approved. Our client, a Chinese postdoctoral fellow engaged in the field of biomedical science, hired North America Immigration Law Group to help him get one step closer to his green card. After carefully evaluating his credentials, we determined that he was ready file his case under the EB-2 NIW (National Interest Waiver) visa category.

Our client’s doctorate in biochemistry and biophysics served as evidence that he possesses the skills and knowledge needed to carry out high quality work in the field of biomedical science. Additional evidence included recommendation letters furnished by other influential biomedical scientists and a breakdown of our client’s professional portfolio.

  1. Recommendation Letters: The six letters that our client obtained were gathered from experts in the field. They firmly expressed their support, and an example includes: “Considering the contributions that [Client] has already made to our immediate scientific field, as well as the greater community that is reliant upon improved health care, I am confident that his continued research is of the utmost importance to our well-being as a nation.”
  2. Professional Credentials: We documented the 50 citations that our client’s 4 published journals papers had collected at the time of filing. This citation and publication record served as proof that other scientists rely on our client’s insights to progress their research.
  3. Additional Evidence: We also detailed our client’s research on pharmaceutical and nutritional interventions to enhance human innate immunity as a means of combating infectious diseases. Our legal team effectively proved to the USCIS that as our client’s work contributes to strengthening human immune defenses, and that his work is important to the health of all Americans. Additionally, we determined that substituting our client with another similarly qualified researcher would adversely affect the national interest of the United States.

We would like to congratulate our client on this milestone. He is currently waiting for his priority date to become current before embarking on the final leg of the green card journey (the I-485 application). When the time comes, we look forward to helping our client accomplish his goal of becoming an American permanent resident.
